Extended Warranty Policy
1. Purpose and Scope
HomeSeer Technologies LLC ("HomeSeer," "we," "us," or "our") provides this Limited Device Replacement Warranty ("Warranty") to the original purchaser ("you" or "Customer") of eligible HomeSeer smart home devices purchased through authorized channels.
This Limited Device Replacement Warranty must be purchased separately and is not provided free of charge.
What This Warranty Covers: This Warranty covers HomeSeer-branded smart home devices, including but not limited to controllers, switches, dimmers, sensors, and other automation devices manufactured or sold by HomeSeer. This is a limited warranty that provides replacement devices for units that fail due to manufacturing defects under normal use conditions.
What This Warranty Provides: Under this Warranty, HomeSeer will replace, at no cost to you, any covered HomeSeer device that fails due to a manufacturing defect within the warranty period. This Warranty provides device replacement only—HomeSeer does not offer repair services under this Warranty.
Geographic Coverage: This Warranty is valid for purchases made by customers with shipping addresses in the United States, Canada, and Mexico. Warranty service is available only within these geographic regions.
Order-Based Coverage: This Warranty covers all eligible HomeSeer devices included in your original purchase order. Warranty coverage is tied to your original order and purchase documentation, not to individual device serial numbers or registration.
Duration: This Warranty provides coverage for four (4) years from the date of your original purchase order for HomeSeer products or five (5) years for wall switches and dimmers.
Warranty Limitations: This is a LIMITED REPLACEMENT WARRANTY that is separate from and in addition to the standard manufacturer's warranty. HomeSeer's obligation under this replacement warranty is limited to replacement of defective devices as described in these terms. This replacement warranty does not cover installation, configuration, technical support, or any costs or damages beyond the replacement of the defective device itself.
2. Warranty Coverage Details
Duration of Coverage
Warranty Periods by Product Category:
Wall Switches and Dimmers: Five (5) years from the date of original purchase
All Other HomeSeer Devices: Four (4) years from the date of original purchase
Warranty Start Date: The warranty period begins on the date of your original purchase order as shown on your receipt, invoice, or order confirmation from HomeSeer or an authorized retailer.
Order-Based Coverage: All devices included in a single purchase order will be covered for the warranty period applicable to each device category. If your order contains both wall switches/dimmers and other devices, each will be covered according to its respective warranty period.
No Extensions or Renewals: These warranty periods are fixed and cannot be extended, renewed, or transferred. There are no additional extended warranty options available.
What is Covered (Manufacturing Defects)
This Warranty covers defects in materials and workmanship that occur during the manufacturing process, including:
Electronic Component Failures:
Defective integrated circuits or microprocessors
Failed capacitors, resistors, or other electronic components
Malfunctioning power supply circuits
Defective relay mechanisms (in switches and dimmers)
Physical Manufacturing Defects:
Cracked or defective housing due to manufacturing flaws
Faulty internal connections or soldering defects
Defective buttons, switches, or mechanical components
LED indicator failures due to manufacturing issues
Premature Component Failure:
Components that fail significantly earlier than expected under normal operating conditions
Hardware degradation due to manufacturing quality issues
Factory assembly errors that cause device malfunction
Sensor and Communication Hardware Issues:
Defective wireless communication modules
Failed environmental sensors (temperature, humidity, motion, etc.)
Antenna or signal processing defects
Normal Operating Conditions: Coverage applies only when devices are used within their specified operating parameters, including proper voltage, temperature range, humidity levels, and installation according to HomeSeer's guidelines.
Manufacturing Defect Determination: HomeSeer will determine whether a device failure constitutes a manufacturing defect based on the symptoms described and photographic evidence provided by the customer.
3. Limited Warranty Exclusions
What is NOT Covered Under This Limited Warranty
This Limited Warranty does not cover device failures or damage caused by factors other than manufacturing defects. The following examples are excluded from warranty coverage and provide a basis for determining whether a claim is covered:
Physical Damage from External Causes:
Damage from drops, impacts, or physical trauma
Damage from improper handling during installation or removal
Scratches, dents, or cosmetic damage that does not affect functionality
Damage from tools during installation or maintenance
Damage from excessive force applied to buttons, switches, or connectors
Environmental and Electrical Damage:
Water damage, moisture intrusion, or exposure to excessive humidity
Damage from power surges, electrical spikes, or voltage fluctuations
Damage from lightning strikes or electrical storms
Damage from extreme temperatures outside specified operating ranges
Corrosion or oxidation due to environmental exposure
Damage from chemical exposure or cleaning agents
Installation and Wiring Issues:
Damage caused by improper electrical wiring or installation
Damage from incorrect voltage or incompatible electrical systems
Damage from faulty or inadequate electrical connections
Damage from installation not following HomeSeer specifications or local electrical codes
Issues caused by inadequate or unstable power supply
Misuse and Abuse:
Damage from use beyond the device's intended purpose or specifications
Damage from unauthorized modifications or alterations to the device
Damage from use of non-HomeSeer replacement parts or accessories
Damage from operating the device outside its specified parameters
Intentional damage or abuse
Normal Wear and Tear:
Cosmetic wear from normal use over time
Gradual degradation of finish or appearance
Normal aging of materials that does not affect functionality
Expected component wear that occurs over the device's intended lifespan
Third-Party and External Factors:
Issues caused by incompatible third-party software or devices
Problems with internet connectivity, Wi-Fi networks, or network infrastructure
Issues with smart home platforms or services not provided by HomeSeer
Compatibility problems with non-HomeSeer systems or devices
Data loss or corruption not caused by hardware failure
Non-Manufacturing Issues
The following issues are considered non-manufacturing problems and are not covered under this Warranty:
Software and Configuration:
Software bugs or glitches that do not stem from hardware defects
Configuration errors or incorrect device setup
Firmware update failures not caused by hardware issues
User interface problems not related to hardware malfunction
Performance and Compatibility:
Reduced performance due to network conditions or interference
Compatibility issues with updated third-party platforms
Changes in smart home ecosystem requirements or protocols
Performance variations due to environmental conditions within normal operating ranges
Acts of Nature and External Events:
Damage from natural disasters (earthquakes, floods, tornadoes, etc.)
Fire damage not caused by device malfunction
Theft, vandalism, or intentional destruction
War, civil unrest, or other extraordinary circumstances
Exclusion Determination: HomeSeer reserves the right to determine whether a device failure falls under warranty coverage or these exclusions based on the description and photographic evidence provided by the customer.
4. Device Replacement Terms
Replacement Policy
Replacement Only: This Warranty provides device replacement exclusively. HomeSeer does not offer repair services for devices covered under this Warranty. All covered warranty claims will be resolved through replacement of the defective device.
New Device Preference: HomeSeer will provide a new, unused replacement device whenever possible. New replacement devices will be identical to your original device model when available in HomeSeer's current inventory.
Equivalent Model Substitution: If your original device model has been discontinued or is not available in new condition, HomeSeer may provide:
A newer model with equivalent or improved functionality
A current production model that serves the same purpose as your original device
A model that maintains compatibility with your existing HomeSeer system
Refurbished Replacements: Refurbished or remanufactured replacement devices will only be provided when new devices are not available. Refurbished devices provided as warranty replacements:
Are fully tested and restored to proper working condition
Meet the same quality standards as new devices
Include the same warranty coverage as new replacement devices
Are provided only as a last resort when new units cannot be supplied
Replacement Device Warranty: Replacement devices provided under this Warranty are covered for ninety (90) days from the date of replacement.
Warranty Obligation Fulfilled: Providing a replacement device under this Warranty completely fulfills HomeSeer's obligation under this Warranty for the original defective device. Once a replacement device is shipped, HomeSeer's warranty obligation ends for both the original device and the replacement device (subject only to the replacement device coverage period stated above).
No Upgrades or Downgrades: HomeSeer will not provide upgrades to higher-end models or accept requests for different device types as warranty replacements. Replacements will be functionally equivalent to the original defective device.
Single Replacement per Device: Each device is eligible for one (1) warranty replacement during the coverage period. If a replacement device fails, it will be covered under the replacement device warranty terms stated above.
Warranty Period Enforcement
Strict Warranty Period Compliance: Warranty coverage expires on the exact date specified for each device:
Wall switches and dimmers: Five (5) years from purchase date
All other HomeSeer devices: Four (4) years from purchase date
No extensions, grace periods, or exceptions to these timeframes
Purchase Date Determination: The warranty period begins on the date shown on your original purchase documentation. HomeSeer will not accept alternative dates or make adjustments to warranty periods based on delivery dates, installation dates, or other factors.
Expired Warranty Policy: HomeSeer will not provide warranty service for devices with expired warranty coverage under any circumstances, including:
Claims filed after warranty expiration, regardless of when the defect occurred
Devices that failed during the warranty period but were not reported until after expiration
Good faith errors in warranty period calculation by customers or retailers
5. Customer Responsibilities
Order Documentation
Retain Purchase Documentation: You must retain your original purchase documentation to be eligible for warranty service. Acceptable documentation includes:
Original purchase receipt from HomeSeer or authorized retailer
Invoice or order confirmation from HomeSeer
Credit card or payment processing statements showing HomeSeer purchase
Email confirmation of order from HomeSeer or authorized retailer
Provide Accurate Purchase Information: When filing a warranty claim, you must provide accurate information about your original purchase, including:
Order number or transaction reference (when available)
Date of purchase
Retailer or purchase source
Products purchased that are subject to warranty claim
No Registration Required: HomeSeer devices do not require registration for warranty coverage. Your purchase documentation serves as proof of warranty eligibility.
Device Care and Operation
Follow Operating Guidelines: To maintain warranty coverage, you must:
Install and operate devices according to HomeSeer's installation instructions and specifications
Use devices within their specified operating conditions (voltage, temperature, humidity ranges)
Follow local electrical codes and safety regulations during installation
Use only HomeSeer-approved accessories and replacement parts
Proper Installation: Devices must be installed:
According to the installation manual provided with each device
By qualified personnel when electrical work is required
In accordance with local building and electrical codes
Within the environmental specifications listed in the product documentation
Reasonable Care: Exercise reasonable care in the use and handling of HomeSeer devices:
Protect devices from physical damage during installation and use
Keep devices clean and free from debris that could affect operation
Avoid exposure to moisture, chemicals, or extreme environmental conditions
Handle devices appropriately during any necessary removal or relocation
Warranty Claim Responsibilities
Timely Reporting: Report device defects promptly after discovery and within the applicable warranty period. Delays in reporting may affect warranty coverage eligibility.
Required Documentation for Claims: When filing a warranty claim, you must provide:
Proof of original purchase (receipt, invoice, or order confirmation)
Clear photographs showing the device and any visible defects or damage
Written description of the problem, including symptoms and circumstances of failure
Contact information for warranty claim processing and replacement device shipping
Cooperation with Warranty Process: You agree to:
Provide truthful and accurate information about device failures
Respond promptly to requests for additional information or documentation
Allow reasonable time for HomeSeer to process warranty claims and ship replacements
Follow HomeSeer's instructions regarding return of defective devices
Consequences of Non-Compliance
Warranty Voidance: Failure to comply with these responsibilities may void warranty coverage, including:
Loss of purchase documentation preventing verification of warranty eligibility
Use of devices outside specified operating conditions
Failure to return defective devices as required
Providing false or misleading information in warranty claims
Replacement Device Obligations: The same responsibilities apply to any replacement devices provided under this Warranty.
6. Warranty Coverage Limitations
Scope of Limited Warranty
Device Replacement Only: This Warranty is limited exclusively to the replacement of defective HomeSeer devices. HomeSeer's sole obligation under this Warranty is to provide a replacement device for units that fail due to manufacturing defects.
No Service Coverage: This Warranty does not cover and HomeSeer is not responsible for:
Installation, setup, or configuration services
Technical support beyond warranty claim processing
Training or instruction on device operation
Integration with third-party systems or platforms
Network setup or troubleshooting
Smart home system design or consultation
No Additional Costs Covered: HomeSeer will not pay for or reimburse:
Installation or removal costs
Electrician or contractor fees
Incidental expenses related to device failure or replacement
Costs associated with system reconfiguration or setup
Original Purchaser Only: This Warranty extends only to the original purchaser of HomeSeer devices. Warranty coverage is tied to:
The original purchase order and billing information
The customer who made the original purchase transaction
The original shipping or billing address from the purchase
Geographic and Shipping Limitations
Geographic Coverage Area: This Warranty is valid only for:
Customers with shipping addresses in the United States, Canada, or Mexico
Devices purchased for use within these geographic regions
Warranty claims filed from these covered territories
Shipping Restrictions: Warranty replacement devices will only be shipped to addresses within the covered geographic area. HomeSeer cannot provide warranty service to customers outside these regions.
Damage and Loss Limitations
No Consequential Damages: HomeSeer is not liable for any consequential, indirect, incidental, special, or punitive damages, including but not limited to:
Loss of use of the device or related systems
Inconvenience or time lost due to device failure
Damage to other property caused by device malfunction
Business interruption or lost profits
Data loss or corruption
Security breaches or privacy concerns related to device failure
Maximum Liability: HomeSeer's maximum liability under this Warranty is limited to the replacement cost of the defective device. In no event will HomeSeer's liability exceed the original purchase price of the defective device.
Property Damage Exclusion: This Warranty does not cover damage to real or personal property, regardless of whether such damage is caused by device defect, malfunction, or failure.
Performance and Compatibility Limitations
No Performance Guarantees: This Warranty does not guarantee:
Specific performance levels or metrics
Compatibility with all third-party systems or software
Continuous operation without interruption
Future compatibility with evolving smart home standards
Technology Evolution: HomeSeer is not responsible for:
Changes in smart home protocols or standards that affect device compatibility
Discontinuation of third-party services or platforms
Updates to other systems that create compatibility issues
Performance degradation due to network or infrastructure changes
Integration Limitations: This Warranty does not cover issues related to:
Integration with non-HomeSeer products or systems
Third-party software compatibility
Smart home platform changes or updates
Network performance or reliability issues
Warranty Modification and Interpretation
No Warranty Expansion: This Warranty cannot be expanded, extended, or modified by:
Verbal statements from HomeSeer representatives
Written materials not part of these official warranty terms
Third-party warranties or guarantees
Retailer or dealer representations
Sole Warranty: This Limited Warranty constitutes the entire warranty provided by HomeSeer and supersedes all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Void Warranty Conditions
Actions That Void This Warranty: This Warranty will be immediately void and HomeSeer will have no obligation to provide warranty service if you participate in any of the following activities with regard to the product under warranty:
Device Tampering or Modification:
Opening, disassembling, or attempting to repair HomeSeer devices
Modifying device hardware, firmware, or internal components
Adding non-HomeSeer components or circuits to devices
Altering device functionality beyond intended specifications
Unauthorized Repairs:
Attempting repairs by unauthorized service providers
Using non-HomeSeer replacement parts or components
Bypassing device safety features or protection circuits
Soldering, rewiring, or making electrical modifications
Installing non-approved firmware or software modifications
Installation Violations:
Installation not in accordance with HomeSeer specifications and instructions
Use of improper wiring, connections, or electrical configurations
Installation in environments exceeding specified operating conditions
Installation by unqualified personnel where professional installation is required
Failure to follow local electrical codes and safety regulations
Misuse and Abuse:
Use of devices for purposes other than their intended smart home automation functions
Operating devices beyond their specified electrical, environmental, or performance limits
Intentional damage, destruction, or abuse of devices
Use in commercial or industrial applications when designed for residential use
Exposure to conditions known to cause damage (excessive moisture, chemicals, extreme temperatures)
7. Warranty Transfer Policy
Non-Transferable Warranty
Warranty Cannot Be Transferred: This Limited Warranty is non-transferable and cannot be assigned, sold, or transferred to any other person or entity under any circumstances. Warranty coverage is limited exclusively to the original purchaser.
Original Purchaser Definition: The original purchaser is defined as:
The person or entity whose name appears on the original purchase order, invoice, or receipt
The individual or business that made the original payment for the HomeSeer devices
The customer associated with the original billing and shipping information from the purchase transaction
No Transfer Upon Sale or Gift: Warranty coverage does not transfer when HomeSeer devices are:
Sold to another person or entity
Given as a gift to another person
Inherited or bequeathed to heirs or beneficiaries
Transferred as part of a real estate transaction
Moved from one location to another under different ownership
Transferred to new tenants or property occupants
Property Transfer Scenarios
Real Estate Transactions: When HomeSeer devices are permanently installed in a property that is sold:
Warranty coverage does not transfer to the new property owner
The original purchaser retains warranty rights only if they can provide original purchase documentation
New property owners must purchase their own HomeSeer devices to receive warranty coverage
HomeSeer is not responsible for warranty claims from new property owners
Business Transfers: In the event of business mergers, acquisitions, or ownership changes:
Warranty coverage does not automatically transfer to new business owners
Original purchase documentation must remain with the original purchasing entity
Successor businesses do not inherit warranty rights from previous owners
New business owners must establish their own warranty coverage through new purchases
Device Relocation: If the original purchaser moves HomeSeer devices to a new location:
Warranty coverage remains valid as long as the original purchaser retains ownership
The device must be properly uninstalled and reinstalled according to HomeSeer specifications
Any damage occurring during relocation is not covered under warranty
Original purchase documentation must be retained for warranty claims
Attempted Transfer Consequences
Void Warranty: Any attempt to transfer warranty coverage will void the warranty for the affected devices. This includes:
Fraudulent warranty claims filed by non-original purchasers
Sharing of purchase documentation with unauthorized parties for warranty purposes
Misrepresentation of ownership in warranty claim submissions
Attempts to assign warranty rights through any legal or informal mechanism
Documentation Verification: HomeSeer reserves the right to verify the identity of warranty claimants by:
Requesting additional proof of original purchase
Confirming billing and shipping address information
Verifying identity through government-issued identification
Cross-referencing warranty claims with original purchase records
No Exceptions Policy
Absolute Non-Transferability: HomeSeer does not make exceptions to the non-transferable warranty policy under any circumstances, including:
Family transfers between relatives
Charitable donations of HomeSeer devices
Business partnerships or joint ventures
Court orders or legal proceedings
Hardship or exceptional circumstances
No Third-Party Warranty Rights: Third parties, including but not limited to contractors, installers, property managers, tenants, and subsequent owners, have no warranty rights or claims under this Warranty regardless of their relationship to the original purchaser or the property where devices are installed.
Retailer and Dealer Limitations: Authorized retailers and dealers cannot:
Transfer their warranty rights to customers
Extend warranty coverage to customers beyond HomeSeer's terms
Make representations about warranty transferability
Process warranty claims on behalf of non-original purchasers
Original Purchaser Verification
Required Verification: To maintain warranty eligibility, original purchasers must be able to provide:
Original purchase documentation (receipt, invoice, order confirmation)
Matching identity information (name, address, payment method)
Accurate purchase date and product information
Contact information consistent with original purchase records
Verification Process: HomeSeer may require verification of original purchaser status at any time during the warranty period through:

Confirmation of billing and shipping address information
Verification of payment method or financial account information
Failed Verification: If HomeSeer cannot verify original purchaser status, the warranty claim will be denied, and no replacement device will be provided.
8. Warranty Claim Submission Process
Initiating a Warranty Claim
Support Portal Access: To submit a warranty claim, you must use HomeSeer's official support portal:

Click “Initiate Return” at the bottom
Create a free account using the same email address used for your original HomeSeer purchase
Select "Replacement” in the portal
Submit your warranty claim through this portal exclusively
A HomeSeer support representative will work with you to determine the best course of action to resolve your claim.
Account Requirements: You must create and use a HomeSeer support account to submit warranty claims. Anonymous submissions are not accepted. The email address used for your support account must match the email address associated with your original HomeSeer purchase order.

Original order number from your HomeSeer purchase

Close-up photo of the Z-Wave QR code (where applicable)
Photo clearly showing any visible damage, defects, or abnormalities
Additional photos as requested by the support representative
Photo Quality Requirements:
Photos must be clear, well-lit, and in focus
Model numbers and identifying marks must be clearly visible
Images should accurately represent the current condition of the device
Photos must be taken of the actual defective device, not stock images or photos of different units
Photo Specifications: Your assigned support representative will provide specific instructions for required photos based on the reported problem and device type. Follow these instructions precisely to avoid delays in claim processing.
Confirmation and Tracking
Automatic Confirmation: Upon successful submission, you will receive:
Automatic email confirmation that your warranty claim has been received
Unique ticket number for tracking your warranty claim status
Initial response timeline and next steps information
Ticket Tracking: Use your assigned ticket number to:
Monitor the progress of your warranty claim
Reference your claim in any future communications with HomeSeer support
Access updates and requests for additional information
Response Timeline: HomeSeer will provide an initial response to your warranty claim within 2-3 business days during normal business hours. Complex claims may require additional time for thorough evaluation.
Multiple Device Claims
Single Ticket Option: If you have multiple HomeSeer devices from the same original purchase order that require warranty service, you may submit a single warranty claim ticket covering all affected devices as long as each has their own warranty.
Multiple Device Requirements: When submitting claims for multiple devices:
List each defective device separately with complete information for each unit
Provide required photographs for each device claimed
Specify which devices are experiencing which problems
Include model numbers and problem descriptions for each device
Ensure all devices are covered under their own applicable warranty periods
Individual Device Processing: Each device will be evaluated and processed individually, even when submitted under a single ticket. Warranty decisions may vary between devices based on their specific conditions and eligibility.
Important Submission Requirements
Complete Information Required: Incomplete warranty claims will be delayed or denied. Ensure all required information and documentation is provided at the time of initial submission to expedite processing.
Accurate Information: All information provided must be truthful and accurate. Misrepresentation of device condition, purchase information, or problem circumstances may void warranty coverage and result in claim denial.
Timely Submission: Submit warranty claims promptly after discovering device defects and within the applicable warranty period for each device. Delays in submission may affect warranty eligibility.
Email Address Matching: The email address used for your support account must match the email address associated with your original HomeSeer purchase. Claims submitted with non-matching email addresses may be delayed or require additional verification.
Business Hours: HomeSeer processes warranty claims during normal business hours. Claims submitted outside business hours will be processed on the next business day.
9. Warranty Claim Verification Process
What to Expect After Submission
Once you submit your warranty claim, here's what happens:
Initial Review (2-3 Business Days) Your claim will be assigned to a HomeSeer support representative who will:
Review your submitted information and photos
Verify your purchase documentation and warranty eligibility
Determine if additional information is needed
Verification Process We will confirm:
Your purchase matches our order records
The device is within its warranty period (5 years for switches/dimmers, 4 years for other devices)
Your claim includes all required documentation
Technical Assessment Our team will evaluate whether the device issue qualifies as a manufacturing defect by reviewing:

Whether the issue matches known manufacturing defect patterns
If the device was used under normal operating conditions
Decision Timeline We complete our review within 3-5 business days of receiving all required information. Complex cases may take additional time.

10. Warranty Claim Fulfillment Process
What Happens After Approval
Once your warranty claim is approved and you accept our replacement offer, we'll get your new device to you quickly.

If your model is discontinued, we'll provide an equivalent or improved replacement
In rare cases when new devices aren't available, we may provide a fully tested refurbished unit

We'll ship your replacement within 1-2 business days
Standard delivery takes 2-5 business days depending on your location
Total time from approval to delivery: typically 3-7 business days

12. Legal Terms and Disclaimers
Governing Law and Jurisdiction
United States: For customers located in the United States, this Warranty shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of laws principles. Any disputes arising under this Warranty shall be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire.
Canada: For customers located in Canada, this Warranty shall be governed by the laws of the province in which the customer resides, and any disputes shall be subject to the jurisdiction of the courts in that province. Where provincial law conflicts with these warranty terms, provincial consumer protection laws shall take precedence to the extent required by law.
Mexico: For customers located in Mexico, this Warranty shall be governed by applicable Mexican federal consumer protection laws and the laws of the state in which the customer resides. Any disputes shall be subject to the jurisdiction of Mexican courts with appropriate jurisdiction.
International Dispute Resolution: HomeSeer will make reasonable efforts to resolve warranty disputes through direct communication and customer service before requiring formal legal proceedings.
Warranty Disclaimers
Additional Replacement Warranty: This Limited Warranty constitutes an additional device replacement warranty provided by HomeSeer Technologies LLC and is separate from the standard manufacturer's warranty that applies to HomeSeer devices. This Warranty does not replace or supersede the standard manufacturer's warranty.
Relationship to Manufacturer's Warranty: HomeSeer devices are covered by both:
The standard manufacturer's warranty (handled separately with its own terms and procedures)
This additional Limited Device Replacement Warranty (with the terms set forth in this document)
No Other Express Warranties for This Program: Regarding this specific device replacement warranty program, HomeSeer makes no other express warranties beyond those set forth in this document.

Third-Party Disclaimer: HomeSeer disclaims all responsibility for warranties, representations, or guarantees made by retailers, dealers, installers, or any other third parties regarding HomeSeer devices.
Limitation of Liability
Maximum Liability Cap: HomeSeer's total liability under this Warranty, whether based in contract, tort, negligence, strict liability, or otherwise, shall not exceed the original purchase price paid by the customer for the specific defective device.
Exclusion of Consequential Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMESEER SHALL NOT BE LIABLE FOR ANY:
Consequential, incidental, indirect, special, or punitive damages
Loss of profits, revenue, data, or use
Business interruption or downtime
Costs of substitute products or services
Property damage not directly caused by manufacturing defects
Personal injury or death (except where prohibited by law)
Time Limitation: Any claim against HomeSeer under this Warranty must be filed within the applicable warranty period. No claims will be accepted after the warranty period expires, regardless of when the defect or damage is discovered.
Multiple Device Limitation: In cases involving multiple devices from the same order, HomeSeer's maximum aggregate liability shall not exceed the total purchase price of all defective devices covered under the warranty claim.
Force Majeure
Excused Performance: HomeSeer shall not be liable for any delay or failure to perform its obligations under this Warranty due to causes beyond its reasonable control, including but not limited to:
Acts of God, natural disasters, or extreme weather conditions
War, terrorism, civil unrest, or government actions
Labor disputes, strikes, or work stoppages
Supply chain disruptions or manufacturing delays
Pandemic, epidemic, or public health emergencies
Internet, telecommunications, or utility failures
Notification and Resolution: In the event of a force majeure situation, HomeSeer will make reasonable efforts to notify affected customers and resume normal warranty service as soon as reasonably possible.
Severability and Modification
Severability: If any provision of this Warranty is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, such provision shall be severed from this Warranty. The remainder of the Warranty shall remain in full force and effect.
No Modification by Third Parties: This Warranty may not be modified, altered, or amended by any person other than HomeSeer Technologies LLC through official written amendment. No retailer, dealer, installer, or other third party has authority to modify these warranty terms.
Modification by HomeSeer: HomeSeer reserves the right to modify this Warranty for future purchases. Changes to warranty terms will not affect devices already purchased and will be communicated through HomeSeer's official channels.
Consumer Protection Law Compliance
Consumer Rights Preservation: Nothing in this Warranty is intended to limit or exclude rights that consumers may have under applicable consumer protection laws that cannot be waived or limited by contract.
Statutory Rights: Where local consumer protection laws provide rights or remedies that cannot be excluded or limited, those rights and remedies shall remain available to consumers in addition to the rights provided under this Warranty.
Regional Variations: In jurisdictions where specific consumer protection requirements apply, this Warranty shall be interpreted and applied in compliance with such requirements.
Legal Notices
Entire Agreement: This Warranty, together with the original purchase documentation, constitutes the entire agreement between the customer and HomeSeer regarding warranty coverage for HomeSeer devices and supersedes all prior or contemporaneous communications, representations, or agreements relating to such warranty coverage.
No Waiver: HomeSeer's failure to enforce any provision of this Warranty shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of HomeSeer.
Assignment: This Warranty may not be assigned by the customer but may be assigned by HomeSeer to any successor entity without notice to the customer.
Language: This Warranty is written and executed in English. In case of any translation into other languages, the English version shall prevail in case of conflicts or discrepancies.
